What data we collect on bwhale.io, what we use it for and how you can control it.

Who is responsible for your data
The data controller is Sistemas Tecnológicos OSystems SpA (trading as BWhale), located at Arlegui 160, Oficina 306, Viña del Mar, Valparaíso, Chile.

The group also operates as BWHALE LLC (Texas, United States). Where processing is carried out by that entity, this same policy applies.
What data we collect
Data you give us voluntarily. If you use the contact form, we collect your name, company, email address, the type of need you select and the message you write. No field asks for sensitive information, and we ask you not to include any in your message.
Technical connection data. Our hosting provider automatically logs the IP address, date and time, and the browser used. These are technical records needed to operate the site and protect it from abuse.
Language and cookie preferences. We store the language you choose and your decision about analytics cookies in your own browser (local storage, not a cookie) so we do not have to ask again. Those values are never sent to any server and you can remove them by clearing site data in your browser.

Cookies and analytics
We use two tools to understand which content is useful. They work differently, which is why we only ask permission for one:
- Cloudflare Web Analytics — uses no cookies and collects no data that could identify you or track you across sites. It only counts page views, general origin and load speed, in aggregate. As it processes no personal data, it needs no consent and is always active.
- Google Analytics 4 — does use cookies and only activates if you accept. Until you do, the tag loads in denied mode (Consent Mode) and writes no cookies at all. We have IP anonymisation enabled and advertising and profiling features disabled.
You can change your mind at any time from the "Cookie preferences" link in the footer. If you withdraw permission, we stop using analytics cookies. You can also delete them from your browser settings.
Declining limits nothing: the site works exactly the same and you lose no functionality.
We use no advertising, remarketing or profiling cookies, and we share no data with advertising networks.
What we use your data for, and on what basis
We use the form data solely to respond to your enquiry and, where relevant, to prepare and follow up on a commercial proposal. The basis for this is your own request: you write to us so that we get in touch.
Technical logs are used to keep the site available and secure, based on our legitimate interest in operating it properly.
We do not sell your data, do not pass it to third parties for commercial purposes and do not use it for advertising. We also make no automated decisions that affect you.
Who we share it with
Only with providers who deliver a service to us and are bound to process data on our instructions:
- Web3Forms — processes the form submission and delivers it to us by email.
- Microsoft Azure — hosts the site and generates the technical logs.
- Cloudflare — measures site usage in aggregate, without cookies.
- Google — Analytics 4, only if you accept analytics cookies.
- Google Fonts — serves the typefaces. Loading them means your browser discloses your IP address to Google, although we set no cookies of theirs.
- YouTube — only on the Configuration Panel and Relay Tester pages, and only if you play the video. We use the no-cookie mode, which avoids tracking until you press play.
These providers are based in the United States, so your data may be processed outside Chile. We select them for offering contractual guarantees of equivalent protection.
We may also disclose information where a competent authority legally requires it.
How long we keep it
We keep form messages for as long as the commercial conversation lasts and, afterwards, for as long as needed to handle obligations arising from any resulting contract. If the enquiry does not progress, we delete them once they are no longer useful.
Server technical logs are kept for short periods, according to our hosting provider policy.
You can ask us to delete your data before those periods at any time.
Your rights
At any time you may exercise your rights of access (know what data we hold), rectification (correct it if inaccurate), erasure (ask us to delete it), objection (ask us to stop processing it), portability (receive it in a reusable format) and blocking (temporarily suspend processing).
To exercise them, write to hello@bwhale.io stating which right you wish to exercise. We will respond within the periods set by applicable law. Exercising these rights is free of charge.
If you believe we have not handled your request properly, you may complain to the relevant data protection authority.
Security
The entire site is served encrypted over HTTPS. We apply reasonable technical and organisational measures to protect information against unauthorised access, loss or alteration.
No system is infallible: should we detect an incident affecting your personal data, we would inform you and act in accordance with applicable law.
Links to other sites
This site links to group properties (calgrow.io, druppify.com) and to our LinkedIn, Instagram and Facebook profiles. Once you leave bwhale.io, the privacy policy of that destination applies, not this one.
Changes to this policy
If we change this policy, we will publish the updated version at this same address and change the last-updated date shown above. We recommend reviewing it from time to time.
